This agreement governs the use of Foonika's studio rooms and equipment. It is accepted once before the first booking, and again whenever its text changes. If translations differ, the Estonian text prevails.
Version 2026-10-20
1.1. Foonika: Kreiter Group OÜ, registrikood 16822721, KMKR EE102790085, Eha tee 19, Kelvingi küla, Viimsi vald, Harju maakond, 74018. Contact: +372 5340 5772, foonika.ee@gmail.com. The studio is at Kopli 27, Tallinn, rooms 203 / 204.
1.2. User: a natural person whose identity has been verified on foonika.ee through the eeID service (Smart-ID, Mobile-ID, ID card or another electronic identification means offered by eeID). Foonika stores the User's first and last name, email address, phone number (if the User provides it) and a pseudonymous identifier derived from the personal identification code. Foonika does not store the personal identification code itself.
2.1. This is a framework agreement. It governs the use of the rooms and equipment during every booking the User makes on the website.
2.2. Each booking is a separate order. The price, payment, cancellation and rescheduling of a booking are governed by Foonika's terms of sale (foonika.ee/tingimused), which form an integral part of this agreement. In case of conflict, the terms of sale prevail on price, payment and cancellation, and this agreement prevails on the use of the rooms and equipment.
2.3. The agreement does not oblige the User to book anything, nor Foonika to hold any time free for the User.
3.1. The agreement is concluded on the website before the User's first booking: the User verifies their identity through eeID, the full text of the agreement is displayed, and the User presses "I agree to the terms of the agreement".
3.2. For the acceptance, Foonika records the User's verified identity (clause 1), the date and time of acceptance, the version of the agreement, the language and checksum (hash) of the text displayed, the electronic identification means, the IP address and the browser identifier. These records prove the conclusion of the agreement and its content.
3.3. After acceptance, Foonika emails the text of the agreement with the acceptance details to the User. The User can also see the agreement and their acceptance in their account.
3.4. To book and manage bookings, the User signs in through eeID. The User does not let anyone else use their electronic identification means or account.
3.5. A person under 18 may conclude the agreement only with the consent of a parent or guardian.
4.1. The User may use the room only during the booked time. The room must be vacated by the end of the booking.
4.2. No more people may be in the room than the number stated in the booking, and never more than the room's capacity.
4.3. The User is responsible for the conduct of the people they bring as for their own.
4.4. In the rooms it is prohibited to smoke (including e-cigarettes), to place food or drinks near the equipment, to open, disconnect or move the equipment or permanently change its settings, and to pass on access details for the room or the building to third parties.
4.5. The User may connect their own devices (e.g. a laptop, headphones, a USB drive) only to the sockets intended for that. Using one's own devices is at the User's own risk.
4.6. After use, the User leaves the room as they found it: equipment switched off according to the instructions in the room and rubbish taken out.
4.7. The User follows the house rules of the building and does not disturb neighbours or other people in the building.
5.1. The User checks the room and equipment within the first 15 minutes of the booking and immediately reports any visible damage or fault to Foonika by phone or email, with a photo where possible.
5.2. If the User has not reported anything within that time, the room and equipment are deemed to have been in order at the start of the booking.
5.3. The User reports a fault arising during use at once. Faulty equipment must not be repaired by the User.
6.1. The User compensates for damage caused through their fault or the fault of the people they bring, including through careless use of the equipment or use contrary to the instructions. Actual damage is compensated: the cost of repair or, where repair is impossible or unreasonable, the market price of an equivalent device.
6.2. The User is not liable for normal wear of the equipment or for faults not caused through their fault.
6.3. Foonika submits a claim for compensation by email, with a description and calculation of the damage, no later than 14 days after the damage is discovered.
7.1. Foonika provides the User, for the booked time, with a clean room and working equipment as described.
7.2. If Foonika cannot fulfil a booking, for example because of an equipment fault or a circumstance preventing use of the room, Foonika offers, at the User's choice, a new time free of charge or a full refund.
7.3. Foonika is not liable for the preservation of the User's recordings, project files and other data, including files left on the computer in the room, nor for personal belongings left in the room. This does not limit Foonika's liability for damage caused intentionally or through gross negligence.
8.1. If the User materially breaches the agreement (for example smokes in the room, intentionally damages equipment, passes on access details or repeatedly stays past the booked time), Foonika may refuse further bookings and terminate the agreement and the User's future bookings. Amounts paid for future bookings are refunded.
9.1. The agreement is concluded for an indefinite term.
9.2. The User may terminate the agreement at any time by writing to foonika.ee@gmail.com. Bookings already paid for remain subject to the terms of sale.
9.3. Foonika may amend the agreement. An amended version applies to the User from the moment the User has accepted it as described in clause 3; until then no new bookings can be made. Bookings already made remain subject to the version the User had accepted at the time of booking.
10.1. Foonika processes the User's personal data to perform the agreement and to prove its conclusion, as described in the privacy policy (foonika.ee/privaatsus).
10.2. The acceptance records named in clause 3 are kept while the agreement is in force and, after it ends, until claims arising from it are time-barred.
11.1. The parties settle disagreements primarily through negotiation. A User who is a consumer may turn to the Consumer Disputes Committee (ttja.ee).
11.2. If no agreement is reached, the dispute is settled in Harju County Court unless the law provides otherwise. The agreement is governed by the law of the Republic of Estonia.
